Auto Parts Distributorship Agrees to Settle EEOC Sex Harassment Lawsuit


Arizona Logistics, Inc. doing business as DSI Arizona, and its management company, Norlyn Enterprises, Inc., has agreed to pay $175,000 to five former employees to settlement a sexual harassment lawsuit filed by the EEOC.

The EEOC alleged in its lawsuit that female employees were subjected to egregious sexual harassment by the company’s Regional Director, Mark Berault. According to the EEOC, Berault sexually assaulted several of the women and engaged in unwelcome touching and indecent exposure. Berault made sexually explicit comments to the women and showed pictures of his private parts to several of them. Despite that the company knew about the sexually hostile work environment, the company failed to take prompt and effective corrective action.

In addition to the settlement requiring that the company pay $175,000 to the female victims, the company will provide significant remedial relief. The Company must (1) not rehire Mark Berault; (2) investigate any further complaints of sexual harassment promptly; (3) provide training for managers and supervisors on conducting sexual harassment investigations; (4) post a notice that harassment of employees will not be tolerated; and (5) provide a letter of regret to each of the victims.
